These are the official contracts for selling and purchasing property and are issued as digital documents via the Dubai broker app (part of Dubailand.gov.ae) by real estate brokers.
Understanding these contracts or forms is essential for both buyers and sellers. These documents protect all parties, define responsibilities, and ensure that transactions comply with the Dubai Land Department (DLD) regulations.
Whether you are entering the market as a first-time buyer or preparing to list a property for sale, knowing how Dubai property contracts work will give you clarity and confidence.
The three essential contracts which outline the terms of property sale on secondary market are:
Each plays a different role in the transaction process.
Form A is the agreement between a property owner or owners (seller) and the real estate brokerage listing the property.
It is mandatory for sellers who appoint an agent to market their property, and it is essential for all secondary market property sales, especially for the advertising activities. A seller may appoint up to 3 agents at any given time.
Form A outlines:
Without a signed Form A, an agent cannot legally advertise or market the property on property portals. It is also essential for entering into the next stage of the selling process (even if the property is sold ‘off market’ - without advertising)
Form B is the agreement between the buyer and the broker.
It confirms:
The Form B is not mandatory for the viewing stages, but it is essential for the next stage - creating the Form F, and sometimes used for negotiating stages also - especially when a property has offers from multiple parties.
The Form F is the most important of all the documents in the selling process - this is the FINAL contract which binds the buyers and seller, with their brokers, to the property which is offered for sale. This document becomes legally binding once signed by all parties on both side and cannot be cancelled by either side independently.
Form F includes:
Once the Form F is signed, it is binding for all parties, and once any NOCs (if required) or bank documents have been obtained, and funds are ready, all parties may proceed to the trustee's office to complete the final stage of the property sale. The trustee's office will review all documents and begin the process to transfer the property into the new owner's name, or names, for final approval by the land department.
Upon completion of the sale, the trustee office will provide the seller with the managers' cheques (issued by the from the buyers bank) representing the sale proceeds.
All sales transactions completed in Dubai require physical managers' cheques, issued by a UAE bank.
There are a few frequent misconceptions:
1. “Form F is optional.”
It is not optional for secondary sales. It is mandatory.
2. “A deposit is enough to secure a property.”
A deposit without a signed Form F is not a legally binding contract and offers no protection.
3. “Only sellers need documentation.”
Buyers also require proper documentation, particularly through Form B and F.
